December 18th, 2023 Monthly Meeting

The Regular Monthly meeting of Local 433 on November 20th, 2023 was called to order at 7:50 pm by President Ryan Shea. 

There was a moment of silence for soldiers throughout the land who have given the ultimate sacrifice for our freedom.

Secretary’s Report: Accepted as read.

Treasurer’s Report: Accepted as read.

Voted on going to Arbitration:

L-01-23, CST-02-21, & McK-04-23: withdrawn

S0-01-23: J.Dugan for a second, going to arbitration

M-11-22: K.Boyd for a second, going to arbitration

5 new grievances:

UWUA-10-23: Authority failed to meet & discuss progressive discipline. Violation of terms & conditions of employment.

RC-10-23: Authority violated own policy on calling off within 30 minutes of shift start.

UWUA-11-23: Authority not paying shift worker for going to PT during off hours. PT not available during night shift.

UWUA-7-23: Authority not providing OT to employees on modified duty in certain departments when others get it.

OPS-10-23: Authority not splitting LP utilities into primary and secondary as outline in split agreement during last contract negotiations.

Chief Steward: Outstanding Grievances:

UWUA-04-21: Unilateral change of work requirements for Covid Vaccine requirement. Pending arbitration.

UWUA-03-21: Requiring a negative test to RTW from Covid. Authority is violating guidance. All employees get time back or paid for unpaid days. Resubmitting information to Authority, requesting formal letter of acceptance or denial. December 2nd, meeting again with names for everyone affected.

McK-0005: Company did not call in to fill spot due to call off. Waiting on arbitration opinion.

M-02-2022: Gabe Kish Jr sent home after reporting yes to Covid questions and negative test provided by Authority. Waiting on Arbitration opinion.

M-10-22: Journeyman posting. Union believes the Authority is continuing to circumvent our contractual apprentice program. Denied by Authority. Working with Attorney on newly found documents.

M-11-22: Denial of job bid for Ryan Coleman. Authority using vague language in Journeyman posting to deny job bid. Denied. Going to Arbitration.

OPS-02-23: Placement of previously qualified employees back at utilities after 2 years. Union seeks employees be placed at field operators rate and position in progression. Going to Arbitration.

RC-01-23: Requiring boat operators to obtain crane license and operate crane outside of job description. Going to Arbitration, waiting on date.

M-01-23: Driver’s license not accepted for Joe Baker. Provided 10 day temporary license, which the Authority refused to accept. Employee took half day to get new license. Union seeks employee be made whole for ½ day lost. Authority denies grievance. Sent to Attorney for opinion.

RC-05-23: Employee was late on weekend all call. Was used in progressive discipline and lost grace period. Employee was then late again and was suspended. Authority has not used weekend lates as part of progressive discipline in past. Union seeks employee be placed in proper progressive discipline spot and made whole for time lost.

UWUA-04-23: Authority refusing to provide health care coverage for retiree spouse until they are aged 65. Violation of CBA at Article 2 Section 8, subsection B. Union seeks Authority cover spouse as language dictates in CBA and make retiree whole for all monies spent. Denied by Authority. Sent to Attorney for Arbitration.

SO-01-23: Authority issued excessive punishment for employee. Punishment does not reflect what previous offenders have received. Union seeks employee be made whole for lost time and record reflect a documented verbal warning.

M-07-23: Authority failed to keep 2nd employee for OT when power equipment was used. Union seeks Gary Brooks be paid for the 4 hours of missed OT.

M-05-23: Authority contracted out the repair of the tugboat before exhausting all resources in house for repair. Union seeks employee be made whole for any time lost. Waiting for reply from Authority.

M-06-23: Authority post Welder Journeyman position. Union seeks Authority follow the CBA Apprenticeship program.

NORTH STRABANE:  

MANOR TOWNSHIP:  Started negotiations, settled for 5 year term

PLEASANT HILLS:  Started negotiations, completed a 4 year contract.

EAST WASHINGTON:  3 new employees, high turnover due to inappropriate pay

BROWNSILLVE: 1 year extension at 3%

WHITE OAK: Arbitration

MCKEESPORT: Arbitration for vacation days

N. VERSAILLES: Employee handbook that includes non bargaining and bargaining and tried to have bargaining unit sign off with caveat about past practices. Waiting for meeting.

ECONOMY: All good

Crew D: A.Gross verbal for incorrect sample times.

REGIONAL CONVEYANCE: P.Riley from RC driver to vactor driver. T.Gavin to RC spotter to Pump Station Laborer. Abby Jones.  S.McKenzie quit on November 3rd. Fact finding meeting with RC crew that marked a structure complete but did not do anything. Dave Schad still out.

MAINTENANCE: Issues regarding employee on modified duty. Employee had meeting for using too many days they did not have.

PR/SCH OUTREACH: Anna Marie Joyce submitted resignation.

LAB:

CS&T: Employee received verbal and written for being late 3 times in a pay period, received a verbal, & then late again and received a written. J.Vogel started data entry.

IW: M.Carver currently out. M.Younger on light duty. Issue with Tina Dean regarding handing out of overtime. 2 employees received verbal warnings for using time they did not have.

MIS, ENGINEERING, PURCHASING, PAYROLL: Employee received a verbal- possible issue with not knowing about policy.

Cope Fund:  October balance: $10,912- $5,000 donation to Sara Innamurato

Old Business: Ongoing discussion with Labor Council regarding monies owed to 433 for satellite unions.
New Business: J.Cisar stepped down as Sgt of Arms. K.Boyd is now second Sgt of Arms.

All 50/50 till New Year going to Labor Council Stuff A Bus. 50/50 winner was K. Reed, donated winnings back to charity.

Motion by Ryan Shea to donate 10 $50 gift cards to Stuff A Bus. 2nd by K.Boyd.

Next month’s meeting is the Christmas party. Catered by JJ’s. Seconded by K.Boyd.
